Welcome to the DCC Jobs website (the Website), which is owned and operated by DCC Jobs Pty Ltd A.C.N.604 198 478 (weusour or DCC Jobs).

Your access to the Website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document (collectively known as Terms of Use). Your use of, and/or access to, the Website constitutes your agreement to the Terms of Use.

If you wish to register as an advertiser of employment vacancies via the Website, then you will be required to agree to our Registration Terms – Advertisers.

If you wish to register as a candidate to apply for employment vacancies via the Website, then you will be required to agree to our Registration Terms – Candidates.

We reserve the right to amend the Terms of Use at any time. Although we may notify you of any amendment, revision or modification, it is your responsibility to periodically review the Terms of Use. You agree to be bound by such changes, modifications or revisions as made by us from time to time.


Our services

We cannot be responsible for any delays or interruptions to the Website. We will use commercially reasonable efforts to minimise delays and interruptions. However, we cannot warrant that the Website will be available at all times or at any given time.

We may at any time and without notice to you, discontinue the Website in whole or in part. However, we cannot be responsible for any loss, cost, damage or liability that may result from our discontinuance of the Website.


Prohibited conduct

In relation to the Website, you must not:

  •  use the Website for any activities or post or transmit via the Website, any information or materials which breach any laws or regulations, infringe a third party’s rights, or are contrary to any relevant standard or codes;

  • use the Website to post or transmit any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any user from using the Website or the Internet;

  • use the Website to send unsolicited email messages;

  • in any way tamper with, hinder or modify the Website;

  • knowingly transmit any viruses or other disabling features to the Website or via the Website; or

  • attempt any of the above acts or facilitate or assist another person to do any of the above acts.


Intellectual Property

The material on the Website, including the software, design, text, images and graphics comprised in the Website and the selection and layout of the Website are owned or under licence by DCC Jobs and protected by Australian and International laws.

Your use of the Website does not grant you a licence or act as a right of use of any of the trade marks or logos, whether registered or unregistered, that are displayed on the Website without the express written permission of the trade mark owner.

We own the copyright, which subsists in all creative and literary works that are displayed on, or accessed via, the Website.

You may view the Website and its contents using your web browser. In visiting the Website, you may make a temporary copy of the Website by means of the usual operation of your web browser only.

You must not:

  • reproduce or use any of the material on the Website for commercial purposes, including sale;

  • in any way modify the material on the Website; or

Indemnity

By using the Website, you agree to indemnify DCC Jobs from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses (whether in tort or in contract including and without limitation, negligence) arising out of or in any way connected to the use of the Website by you.


Disclaimer

Some legislation such as the Australian Consumer and Competition Act 2010 (Cth) and other similar consumer protection laws and regulations in other countries may confer you with rights and remedies relating to the provision of goods or services to you by us via the Website which cannot be excluded, restricted or modified (your “Statutory Rights”). We exclude all conditions and warranties implied by custom, law or statute except for your Statutory Rights.

To the extent permitted by law, including but not limited to any act or omission on your part, we will not be liable for any loss, damage, costs or expense whether direct, indirect, incidental, special and/or consequential, including loss of profits, suffered by you or claims made against you which result from any use or access of, or any inability to use or access, the Website.

You expressly acknowledge that we do not exert control over users of the Internet and we are not liable for damage suffered by you, either directly or indirectly, as a result of your access to the Website.


Limitation of Liability

To the extent permitted by law, our liability for breach of any implied warranty or condition, which cannot be excluded by the Terms of Use, is limited, at our option, to one or more of the following:

In the case of services supplied or offered by us:

  • the resupply of the services; or

  • the payment of the cost of having the services resupplied.

  • In the case of goods supplied or offered by us:

  • the replacement of the goods or the supply of equivalent goods;

  • the repair of such goods;

  • the payment of the costs of replacing the goods or acquiring equivalent goods; or

  • the payment of the costs of having the goods repaired.


Privacy

By agreeing to and accepting the Terms of Use, you also agree to our Privacy Policy.


Termination

The Terms of Use are effective until terminated by us, which we may do at any time and without notice to you. In the event of termination, all restrictions imposed on you by the Terms of Use and limitations of liability set out in the Terms of Use will survive.


Miscellaneous

We rely upon your continued observance of the Terms of Use. If we suffer loss or damage or incur any costs associated with any breach by you of the Terms of Use or any associated legal obligation, you agree to indemnify us for those losses, damages and costs.

We do not make any claims that the information is appropriate or may be downloaded in all areas, countries or jurisdictions. Access to the information contained in the Website may not be legal by certain persons or in certain countries. If you access the Website, you do so at your own risk and you are responsible for compliance with the laws of your jurisdiction.

If any provision of the Terms of Use is found to be invalid or unenforceable by a Court of Law, such invalidity or unenforceability will not affect the remainder of the document, which will continue in full force and effect.

Rights not expressly granted in the Terms of Use are reserved.

If we do not act in relation to a breach of the Terms of Use by you, this does not waive our rights to act with respect to subsequent or similar breaches of the Terms of Use by you.


Applicable Law

The Terms of Use are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of Queensland and Courts of Appeal from them for determining any dispute concerning the Terms of Use.

REGISTRATION TERMS - ADVERTISER

These Registration Terms (these Terms) set out the terms that govern your use of the services offered via the DCC Jobs website, which may be accessed via www.diversecitycareers.com (the Website). This document is a legally binding agreement between DCC Jobs Pty Ltd A.C.N.604 198 478 (we, us, our or DCC Jobs) and you (the Advertiser).

DCC Jobs provides the Advertiser with a platform to post job vacancies (Listings) and to access candidates for employment (Candidates) via the Website (the Service).

Your decision to create an account via the Website (the Account) means that you acknowledge that you have read and understood these Terms and agree to be bound by them. Your access to the services offered by DCC Jobs is conditional upon your acceptance and ongoing compliance with these terms.

You warrant that you are not associated with, or connected to, a recruitment agency.

We reserve the right to:

  • decline, for any reason whatsoever, any request for registration for the Services via the Website; and

  • amend, revise or modify these Terms at any time and without notice to you.


Your Use of the Services

In order to use the Services, you must register as a member via the registration process on the Website.


Registration

Registration occurs when the Advertiser creates an Account via the Website. When creating the account, you warrant that:

  •  you will provide accurate, current and complete information;

  • you are solely responsible for maintaining the confidentiality of your Account log-in information, such as username, password, and any other identifying information, and are solely responsible for all activities that occur under your Account;

  • · you will not use another person’s account without permission from the owner of that Account; and

  • you will immediately notify DCC Jobs of any unauthorised use of your Account or any other breach of security. DCC Jobs will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your password secure.

After your Account is created, you may change information relating to the Account and undertake to update details relating to your Account with true and accurate information at all times.

We undertake to take all due care with any information you provide to use when creating, updating and accessing your Account, and we agree to comply with Australian Privacy laws as set out in the DCC Jobs Privacy Policy.

Registration via the Website entitles the Advertiser to a non-exclusive, non-transferable right to access and use the Services, subject to these Terms. The Advertiser agrees to be solely responsible for any conduct associated with, or originating from, an Advertiser’s Account.


Term of Agreement

The agreement between the parties that is governed by these Terms will continue until such time that a party wishes to terminate pursuant to these Terms.


Listings

As an Advertiser, you may be required to provide information, images and other material (Content) about Listings that you wish to advertise via the Website. You will be required to log in to your Account to provide Content.

You understand and agree that DCC Jobs retains the right to review all Content and may, in our sole discretion, refuse and/or modify any Content contained in the Listings.

You warrant that any Listing that you make or Content that you upload via your Account:

  • is a genuine position for employment as described in the Listing and that this is the sole purpose of the Listing;

  • is not defamatory, offensive, indecent or objectionable;

  • is not capable of misleading or deceptive to Candidates or potential candidates in any way; or

  • does not contravene any anti-discrimination laws or any other law.

You are solely responsible for ensuring that you do not breach any copyright laws (of any country) when uploading Content via the Website. We will not accept any responsibility whatsoever in relation to copyright infringement caused by your Listings on the Website.


Payments

All payments for the Services must be made in accordance with any terms and payment methods specified on any invoice issued by us.

All prices displayed on the Website are in Australian dollars (AUD) and exclude GST.

DCC Jobs may charge the Advertiser interest on an overdue payment owed to us at the rate of 1.5% per calendar month, calculated daily. We may also disable your Account or remove Listings until such that any overdue invoice and applicable interest is paid to us in full.


Prohibited Conduct

In relation to our Services, you must not:

  • use our Services for any activities, or post or transmit via the Website, any information or materials which breach any laws or regulations, infringe a third party’s rights, or are contrary to any relevant standard or codes;

  • use our Services to post or transmit any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any user from using the Website or the Internet;

  • use our Services to send unsolicited commercial electronic messages;

  • in any way tamper with, hinder or modify the Website;

  • knowingly transmit any viruses or other disabling features to the Website or via the Website; or

  • attempt any of the above acts or facilitate or assist another person to do any of the above acts.


Termination

DCC Jobs may terminate these Terms or your Account if, in the view of DCC Jobs, the Advertiser has committed any material breach of these Terms and in the case of a breach capable of being remedied, has failed to remedy the breach within seven (7) days after the receipt of a written request from DCC Jobs.


Relationship Between Parties

The relationship between DCC Jobs and the Advertiser is contractual only and does not create a relationship of employment, partnership or any other legal relationship. Consequently, DCC Jobs cannot, and will not, be liable for any actions, claims, suits, demands, damages, liabilities, costs or expenses (whether in tort or in contract including and without limitation, negligence) arising out of or in any way connected to an Advertiser’s decision to become a registrant via the Website or to employ any Candidate via the Website.


Representations and Warranties

Subject to all applicable laws, the Services provided by DCC Jobs are provided ‘as is’ and we make no representation or warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

DCC Jobs will use its best efforts, techniques and accepted standards in performing the Services. However, we do not warrant that the Services will achieve any specific outcomes.

You warrant that you will not use any information relating to Candidates in any way that may be in breach of the Spam Act 2003 (Cth) or the Australian Privacy Principles contained in the Privacy Act 1988 (Cth).


Exclusions and Limitations of Warranty

To the extent permitted by law, DCC Jobs will not be liable for any loss or damages, whether direct, indirect, incidental or consequential, arising from:

  1. suspension or cancellation of a Candidate’s Account;

  2. your use of the Service;

  3. any interruptions or delays in accessing the Website or any third party websites; or

  4. circumstances beyond the reasonable control of  DCC Jobs

whether in contract, tort (including negligence) or otherwise.

All conditions and warranties, which may be implied by law into these Terms, are excluded except to the extent that it would be unlawful to do so.

To the extent permitted by law, our liability for breach of any implied warranty or condition, which cannot be excluded by these Terms, is limited, at our option, to one or more of the following:

  • the resupply of the Services; or

  • the payment of the cost of having the Services resupplied.


Indemnity

To the fullest extent permitted by law, you agree to indemnify DCC Jobs from any liability for any loss, damage, costs or expense whether direct, indirect, incidental, special and/or consequential, including loss of profits, suffered by you or claims made against you which result from your use of our Services.


Assignment

The Advertiser shall not assign, transfer or sub-licence any of its rights or obligations under these Terms, except with the prior written consent of DCC Jobs.


General

If any provision of these Terms is found to be invalid or unenforceable by a Court of Law, such invalidity or unenforceability will not affect the remainder of the document, which will continue in full force and effect.

All rights not expressly granted in these Terms are reserved.

If we do not act in relation to a breach of these Terms by you, this does not waive our rights to act with respect to subsequent or similar breaches of these Terms by you.

These Registration Terms (these Terms) set out the terms that govern your use of the services offered via the DCC Jobs website, which may be accessed via www.diversecitycareers.com (the Website). This document is a legally binding agreement between DCC Jobs Pty Ltd A.C.N.604 198 478 (we, us, our or DCC Jobs) and you (the Candidate).

DCC Jobs provides the Candidate with a platform to set up a profile (Profile) for the purpose of obtaining employment via the Website (the Service).

Your decision to create an account via the Website (the Account) means that you acknowledge that you have read, understood and agree to be bound by the terms contained in this document. Your access to the services offered by DCC Jobs is conditional upon your acceptance and ongoing compliance with these terms.

We reserve the right to amend, revise or modify these Terms at any time and without notice to you.


Your Use of the Services

In order to use the Services, you must register via the Website.

By registering as a candidate, you agree that you are aged 18 years or over.

If you are aged less than 18 years, then you must (if required) be able to confirm that you have obtained consent from a parent and/or guardian to register as a Candidate and to use the Services.

You agree and acknowledge that all advertisements for employment on the Website and the content of those advertisements are the responsibility of the relevant advertiser and not DCC Jobs. Therefore, it will be your sole responsibility to satisfy yourself that any advertisement for employment is genuine and appropriate to the advertised role.


Registration

Registration occurs when the Candidate creates an Account via the Website. When creating the account, you warrant that:

  • you will provide accurate, current and complete information;

  • you are solely responsible for maintaining the confidentiality of your Account log-in information, such as username, password, and any other identifying information, and are solely responsible for all activities that occur under your Account;

  • you will not use another person’s account without permission from the owner of that Account; and

  • you will immediately notify DCC Jobs of any unauthorised use of your Account or any other breach of security. DCC Jobs will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your password secure.

After your Account is created, you may change information relating to the Account and you undertake to update details relating to your Account with true and accurate information at all times.

Registration entitles the Candidate to a non-exclusive, non-transferable right to access and use the Services, subject to the terms and conditions of this Agreement. The Candidate agrees to be solely responsible for any conduct associated with, or originating from, the Candidate’s Account.


Term of Agreement

The agreement between the parties that is governed by these Terms will continue until such time that a parties wishes to terminate pursuant to these Terms.


Profile

As a Candidate, you will be required to provide information and other material (Content) when creating your profile (Profile) via the Website. You will be required to log in to your Account to create your Profile.

You understand and agree that DCC Jobs retains the right to review all Content and may, in our sole discretion, refuse and/or modify any Content.

You are solely responsible for ensuring that you do not breach any laws (of any country) when uploading Content via the Website to create your Profile. We will not accept any responsibility whatsoever in relation to your Profile, particularly, but not limited to, any misleading misrepresentations that you may make.

Relationship Between Parties

The relationship between DCC Jobs and the Candidate is contractual only and does not create a relationship of employment, partnership or any other legal relationship. Consequently, DCC Jobs cannot, and will not, be liable for any actions, claims, suits, demands, damages, liabilities, costs or expenses (whether in tort or in contract including and without limitation, negligence) arising out of or in any way connected to a Candidate’s decision to become a member of the Website or to participate in any employment as a consequence of the Website.


Representations and Warranties

Subject to all applicable laws, the Services provided by DCC Jobs are provided ‘as is’ and we make no representation or warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

DCC Jobs will use its best efforts, techniques and accepted standards in performing the Services. However, we do not warrant that the Services will achieve any specific outcomes.


Exclusions and Limitations of Warranty

To the extent permitted by law, DCC Jobs will not be liable for any loss or damages, whether direct, indirect, incidental or consequential, arising from:

  • your use of the Service;

DCC Jobs members will receive occasional emails from us in the format of newsletters and special announcements. Your email will not be passed onto third parties without your consent and you can unsubscribe at any time.

If any provision of these Terms is found to be invalid or unenforceable by a Court of Law, such invalidity or unenforceability will not affect the remainder of the document, which will continue in full force and effect.

All rights not expressly granted in these Terms are reserved.

If we do not act in relation to a breach of these Terms by you, this does not waive our rights to act with respect to subsequent or similar breaches of these Terms by you.
